General Provisions
1.1. These e-shop rules (the “Rules”) shall constitute a legally binding document for the Buyer and the Seller (the “Seller”), setting out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Terms and Conditions at any time. The Buyer shall be informed of any changes to the Terms and Conditions on the website of the e-shop.

Entering into the Sale and Purchase Agreement
2.1. The Sale and Purchase Agreement shall be deemed to have been concluded between the Buyer and the Seller when the Buyer creates and submits an order for products in the e-shop, having first read these Terms and Conditions.

The Seller’s Rights
3.1. Under extraordinary circumstances, the Seller may suspend or terminate the operation of the e-shop, without giving an advance notice to the Buyer.
3.2. If the Buyer attempts to undermine the operation, stability and security of the e-shop, or violates their obligations, the Seller shall have the right to restrict or suspend the Buyer’s access to the e-shop without notice.

The Seller’s Obligations
4.1. The Seller shall ensure the availability of the services of the e-shop, with its operations governed by these Terms and Conditions.
4.2. The Seller shall deliver the products purchased by the Buyer using the delivery option of the Buyer’s choice, following the terms and conditions set out in these Sale and Purchase Terms and Conditions.
4.3. In cases where the Seller is unable to deliver the products ordered through the e-shop due to unforeseen circumstances, the Seller shall have the right to terminate the Purchase and Sale Agreement subject to giving prior notice to the Buyer. The Seller may offer a comparable product to the Buyer. On the Buyer’s refusal, the Seller shall refund the money paid within 3 business days.
4.4. If the Buyer exercises the right provided for in Clause 5.2 of the Terms and Conditions, the Seller shall reimburse the Buyer within 5 (five) business days from the date of receipt of the returned products.
4.5. The Seller may not refund the amounts paid by the Buyer until the products have been returned to the Seller, or until the Buyer provides proof that the products have been dispatched to the Seller, whichever comes first.

The Buyer’s Rights
5.1. The Buyer shall be entitled to purchase products at the e-shop, in accordance with these Terms and Conditions.
5.2. The Buyer shall have the right to withdraw from the Sale and Purchase Agreement for goods concluded at the e-shop, by giving the Seller a written notice 14 (fourteen) calendar days or more from the date of the delivery.
5.3. The Buyer may exercise the Buyer’s right as set out in Clause 5.2, provided that the products have not been damaged or had their appearance substantially altered and have not been used.

The Buyer’s Obligations
6.1. The Buyer shall pay for, and shall accept the products purchased, in accordance with these Terms and Conditions.
6.2. In the case of refusing to accept the products at the time of the delivery without a valid reason, the Buyer shall be liable to pay the costs of returning the goods upon the Seller’s request.
6.3. At the time of the delivery of the products to the Buyer, the Buyer shall inspect the condition of the consignment and the product(s) in the presence of the Seller or the person delivering the consignment.
6.4. By accessing the e-shop, the Buyer shall accept and follow these Sale and Purchase Terms and Conditions.

Product Prices
7.1. The prices of the products in the e-shop shall be stated in euros. The prices shall be inclusive of VAT. Once the order has been confirmed, the total amount shall be recalculated to include the delivery charges, if any.

Placing Orders and Payment
8.1. When he/she visits the e-shop, the Buyer shall choose the items they like and add them to the cart. After the cart has been created, the Buyer shall enter the personal data necessary for the delivery of the order, including his/her name, last name, delivery address, telephone number and any additional information that may be relevant for the delivery of the products ordered. The Buyer shall acknowledge having read these Terms and Conditions, and shall confirm the order.
8.3. Payments can be made using Swed, Seb, Luminor, Citadele, Šiaulių Bankas online banking services, as well as Visa/MasterCard payment cards. Payments may be made in euros.

Delivery
9.1. When placing an order, the Buyer shall indicate the correct address for the delivery.
9.2. The Buyer shall accept the products himself/herself. If the Buyer cannot accept the products himself/herself, but the products have been delivered to the address specified by the Buyer, he/she shall not have the right complaint about the products having been delivered to the wrong person.
9.3. The Seller shall deliver the products to the Buyer, in accordance with the terms specified in the descriptions of the products.
9.4. The features of all the products in stock shall be listed in the description of each product. The Seller shall not be held liable if the colour, shape or other parameters of the products in the e-shop do not match the actual size, shape and colour of the products due to the specifications of the Buyer’s screen.
9.5. In the event of the Buyer’s withdrawal from the Sale and Purchase Agreement for the products, the Buyer shall be refunded all sums paid by him/her, including the delivery costs paid by the Buyer.

Final Provisions
11.1. The present Terms and Conditions are drafted in accordance with the legislation of the Republic of Lithuania.
11.2. The present Terms and Conditions, and the relationship between the Parties hereto, shall be governed and construed in accordance with the laws of the Republic of Lithuania.
11.3. Any disagreements arising from the enforcement of these Terms and Conditions shall be resolved by way of negotiations. In cases where the Parties are unable to reach an agreement, the disputes shall be settled in the manner prescribed by the laws of the Republic of Lithuania.
11.4. The Parties shall be released from honouring their obligations hereunder if they are prevented from doing so by unforeseeable circumstances (force majeure) that are outside of the Parties’ control.
